Liquor Commission

Establishment of the Liquor Commission

The Liquor Commission was established under the Liquor Commission Act 2018.

The commission is an independent statutory authority with extensive powers to regulate liquor licensing in the Northern Territory. It is the primary decision-maker in regards to liquor licence applications and in hearing and determining complaints under the Liquor Act 2019.

The commission is supported by the Department of Industry, Tourism and Trade’s Licensing NT division. Licensing NT supports the commission by investigating complaints, monitoring licensed venues, enforcing liquor laws and compiling reporting requirements.

Liquor Commission decisions

After the Liquor Commission, or its delegate, has made a decision in respect of certain liquor matters, either under the Liquor Act 2019 or under the Liquor Commission Act 2018, a decision notice is issued.

A decision notice is a written notice setting out the:

  • decision and the reasons for it
  • right of an affected person to seek a review of the decision before the Northern Territory Civil and Administrative Tribunal.

Review of decisions

Under the Liquor Commission Act 2018, the Liquor Commission can delegate its powers and functions under either the Liquor Commission Act 2018 or the Liquor Act 2019 to the director of liquor licensing.

The Liquor Commission has the power to review decisions made by the director of liquor licensing under the Liquor Act 2019 upon application by an affected person.

In general terms, an affected person is someone who has been involved with the application or matter determined by the director of liquor licensing, such as an applicant, a person who objected to an application, or a licensee who is the subject of a complaint.

An application for review must be made within 28 days after written notice of the director of liquor licensing’s decision is given to the affected person. Although the commission has the power to extend the time allowed for making an application, a person who believes they are an affected person should take steps as soon as possible to lodge an application for review.

The application must clearly state the grounds on which it is made, and the facts relied on to establish the grounds for review.


Liquor Commission hearings

Section 21 of the Liquor Act 2019 provides that a hearing may be conducted by the Liquor Commission on any matter that it may make a decision on under the Act.

A hearing conducted by the commission must be in public, unless the commission is of the view that it is not appropriate, such as where commercial‑in‑confidence information requires protection or undue hardship may be caused to a person.

Hearings are open to the public, unless the commission directs otherwise, to ensure that:

  • the commission’s procedures and processes are subject to scrutiny
  • people involved in the matter can expand on any written submissions or objections they have made, and discuss issues with the commission in a public forum
  • the commission can explain its thinking and receive valuable feedback.

Audio and / or video recording of proceedings by the public (including media) is not allowed.

Public notice – COVID-19 measures

In response to the relaxation of COVID-19 measures, the Liquor Commission has determined to resume the conduct of public hearings unless it determines that conducting a public hearing is not appropriate, as provided for under section 21(2) of the Liquor Act 2019.

To reduce the number of possible people in waiting areas, persons are encouraged to telephone 08 8999 1800 and provide their name and a contact number to be called immediately ahead of required attendance.

With sufficient notice, the commission can arrange for appearance by audio visual link, telephone or attendance in person provided that room capacity is not exceeded. To make arrangements, email liquor.commission@nt.gov.au.


Liquor Commission hearing dates

Under the Liquor Act 2019, the Liquor Commission has discretion to conduct a hearing in relation to any matter on which it is to make a decision.

The Liquor Commission has broad powers to determine how the hearing will be conducted, including the power to require a person to appear before it to give evidence on oath.

The Liquor Commission can determine to conduct a hearing, or part of a hearing, in private in certain circumstances or by way of written submissions only.

Application for liquor licence and authority

For information and forms on how to apply for a liquor licence or an authority go to the Northern Territory Government website.

A range of applications can be made in relation to a liquor licence pursuant to the Liquor Act 2019:

  • a new liquor licence or an authority - section 52 of the Act
  • variation of the conditions of a licence - section 110 of the Act
  • substitution of other premises for the licensed premises - section 75 of the Act
  • transfer of licence - section 72 of the Act
  • material alteration to the licenced premises - section 96 of the Act.

When considering certain applications, the decision maker is required to apply the public interest and community impact test set out in section 49 of the Act and the purposes of the Act at section 3. Each application is assessed on its merits.

Section 51 places the onus on the applicant to satisfy the Northern Territory Liquor Commission that issuing the licence or authority is in the public interest and will not have a significant adverse impact on the community.

Public interest and community impact assessment

The commission may only issue a licence or an authority if satisfied that:

  1. the applicant is a fit and proper person, and
  2. issuing the licence or authority is in the public interest, and
  3. the licence or authority will not have a significant adverse impact on the community.

To determine whether issuing a licence or an authority is in the public interest the commission is required to consider the following objectives:

  1. minimising the harm or ill-health caused to people, or a group of people, by the consumption of liquor
  2. ensuring liquor is sold, supplied, served and consumed on or in licensed premises in a responsible manner
  3. safeguarding public order and safety, particularly when large numbers of people would be attracted to licensed premises or an area adjacent to those premises
  4. protecting the safety, health and welfare of people who use licensed premises
  5. increasing cultural, recreational, employment or tourism benefits for the local community area
  6. promoting compliance with the Act and other relevant laws of the Territory
  7. ensuring each person involved in the business conducted at licensed premises receives training suitable to the person's role in the business
  8. preventing the giving of credit in sales of liquor to people
  9. preventing practices that encourage irresponsible drinking
  10. reducing or limiting increases in anti-social behaviour.

To determine whether issuing a licence or an authority would have a significant adverse impact on the community, the commission must consider the following:

  1. risk of undue offence, annoyance, disturbance or inconvenience to persons who reside or work in the vicinity of the proposed licensed premises or who are using, or travelling to or from, a place of public worship, a hospital or a school
  2. geographic area that would be affected
  3. risk of harm from the excessive or inappropriate consumption of liquor
  4. people or community who would be affected
  5. effect on culture, recreation, employment and tourism
  6. effect on social amenities and public health
  7. ratio of existing liquor licences and authorities in the community to the population of the community
  8. effect of the volume of liquor sales on the community
  9. community impact assessment guidelines issued under section 50
  10. any other matter prescribed by regulation.

The commission may mitigate a possible adverse impact on the community by issuing a licence or an authority with conditions that limit any of the following:

  1. kinds of liquor that may be sold or served
  2. manner in which liquor may be sold or served
  3. number or types of containers in which liquor may be sold or served
  4. days and times when liquor may be sold or served
  5. number of persons who may be on or in licensed premises, a part of licensed premises or an adjacent area that is under the control of the licensee
  6. nature of entertainment that may be provided on or in licensed premises or in an adjacent area that is under the control of the licensee
  7. any promotional activities in which drinks are offered on a complimentary basis or at reduced prices.

Community impact assessment guidelines

The minister has published community impact assessment guidelines to assist in the assessment of the potential impact of issuing a licence or an authority on the community.

Community impact assessment guidelines

The minister must, by Gazette notice, issue community impact assessment guidelines to assist in the assessment of the potential impact of issuing a licence or an authority on the community.

The minister may, in the community impact assessment guidelines, require an applicant for a licence or an authority to provide documents or other information, including information about the:

  1. suburb, local government area or other area in which the proposed licensed premises would be located, and
  2. benefits the proposed licence or authority would provide to the local and broader community, and
  3. process and result of consultation on the application.

The mere addition of a new licence or licensed premises in a community is not taken to be a benefit to the community.

The community impact assessment guidelines may have general, limited or varied application.

Section 49 of the Act and the community impact assessment guidelines should be considered when preparing your application.

While it is up to the applicant to determine how much information to provide to the commission, it should be noted that:

  • objective evidence is required
  • assumptions, opinions, speculation and generalised statements alone will not be sufficient, and
  • applicants should provide supporting evidence that is objective, accurate and relevant to their application.

Local liquor accords

Local liquor accords (accords) are written voluntary agreements between liquor licensees and other stakeholders that address the supply of liquor, trading hours and other matters relating to the management or conduct of a liquor licensed business with the purpose of preventing or reducing alcohol-related violence.

Accords are approved by the Director of Liquor Licensing.

Liquor Commission meeting dates

The Liquor Commission conducts meetings to determine issues across a range of its responsibilities. In addition, special meetings are held on an 'as needs' basis in relation to specific and urgent matters that can arise from time to time.

The Liquor Commission held its last biannual meeting on 24 February 2023. The next meeting is scheduled to be held on 29 August 2023.

Liquor Commission members

The Liquor Commission consists of at least four appointed members, with three members (chairperson and two members - one with a health background) required to be in attendance for a hearing.

The chairperson must be a lawyer with a minimum of five years post-admission experience and be of good standing in the community. The deputy chairperson shares the same qualifications as the chairperson, and also enjoys good standing in the legal profession. The deputy chairperson stands in as the chairperson from time to time, when needed.

At least one sitting member must have a health background.

The minister can also appoint others to the commission if satisfied that they have the appropriate knowledge, experience and expertise to make a valuable contribution.

Russell Goldflam
Russell has served as a member of the Commission since its inception in 2018, acting as Deputy Chairperson when required. Based in Alice Springs, Russell worked in senior positions at NT Legal Aid Commission (NTLAC) until 2018, and continues to work part-time as the Managing Solicitor with the NTLAC. Russell has served on a variety of boards, committees, and advisory groups and has been a proactive advocate in alcohol harm minimisation.
Deputy chairperson -
Jodi Truman
Jodi has served as the Deputy Chairperson of the Commission since its inception in 2018. Jodi is a local long-term barrister who has undertaken litigation practice with specialisation in criminal and family law. Currently, Jodi is a legal member for the Mental Health Review Tribunal and a qualified Family Dispute Resolution practitioner, as well as a qualified Arbitrator under the Family Law Act 1975.
Prof Phillip Carson Dr Carson is a longstanding member of the medical profession in the NT. He practices as a specialist general surgeon in Darwin and is an Associate Professor of Surgery with the Flinders NT Medical Program.
Elizabeth Stephenson Elizabeth has been employed in Darwin, Nhulunbuy and Maningrida in the conduct of clinical duties since 1995 including clients with tuberculosis and leprosy.
Bernard Dwyer Bernard has worked in the field of alcohol and other drugs and mental health service provision for over 40 years, with more than 30 years' service in the NT.
Katrina Fong Lim Katrina is a born and bred fifth generation Territorian with a keen sense of public service and community. She is the former Lord Mayor of the City of Darwin and holds a number of professional and community memberships.
Dr Sean Taylor Dr Taylor holds the positions of Deputy Director Indigenous Leader and Engagement, Menzies School of Research and Executive Director Aboriginal Health Practitioner, NT Health.
Denys Stedman Denys is the Territory’s first Buy Local Industry Advocate, and for over 30 years held senior positions at KPMG and its predecessor accountancy practices. As part of a four-person panel, he undertook a review of the alcohol policies and legislation (“the Riley Review”).
Rachael Shanahan Rachael is the Director and Secretary of the NT Museums and Art Galleries Foundation, and serves on the City of Darwin Arts and Cultural Development Advisory Committee and the 'Darwin Frocktails' City of Darwin's organising committee.

Section 64 of the Liquor Act 2019 requires the director of liquor licensing to keep a register of licensees that includes the following information, the:

  1. name and address of the licensee
  2. address of the licensed premises and the geographic and population area in which the licensed premises are located
  3. date the licence was issued
  4. authorities issued to the licensee
  5. conditions on the licence or authority.

Policy and procedures manual

The main purpose of this manual is to provide members of the commission with information to help them exercise their powers and perform functions under the Liquor Commission Act 2018 and the Liquor Act 2019. The commission has decided to publish the manual to allow members of the public to better understand how the commission works, and to make the commission’s decision-making processes more transparent and accountable.

The manual includes the commission’s guidelines specifying the types of pecuniary interests that a member must disclose under section 21 of the Liquor Commission Act 2018.

Forms

Section 29(2) of the Liquor Commission Act 2018 provides for the following persons to apply to the commission for a review of a decision of the director of liquor licensing:

  1. the applicant affected by a decision regarding an application
  2. any person affected by a decision regarding disciplinary action
  3. a licensee affected by a decision regarding the licence or authority held by the licensee
  4. any person who made a submission, complaint or objection during the process that resulted in the decision
  5. any other person given a right to review under the Liquor Act 2019.

Codes of practice

Section 20 of the Liquor Act 2019 provides that the commission may establish codes of practice to regulate the following matters, the:

  1. advertising and promotion of liquor by licensees
  2. conduct of business under a licence or an authority
  3. operation of licensed premises
  4. management of customers, purchasers and patrons by licensees, including the management of their safety
  5. establishment of ethical standards and practices for licensees.

The commission is required to publish any code of practice it establishes.

It is a condition of a licence that the licensee comply with the provisions of any code of practice established and published by the commission.

Reportable transactions in Central Australia

On 3 November 2020, the Northern Territory Civil and Administrative Tribunal (NTCAT) imposed reportable transaction conditions on a number of liquor licences that authorise the sale of take-away alcohol for licensees in Alice Springs region and the Kulgera and Erldunda Roadhouses.

Initially the Liquor Commission notified all Alice Springs takeaway outlets that it intended to impose those conditions via its own motion powers under section 33 of the previous Liquor Act 1978. Six of the affected licensees sought a review of that decision by NTCAT.

The reportable transaction conditions do not currently apply to liquor outlets that did not join the NTCAT review. The Liquor Commission is currently addressing this situation.

The reportable transaction conditions were introduced to curb secondary supply of liquor and grog running into dry communities in and around Alice Springs. This illegal and irresponsible activity has the potential to negatively impact on the wellbeing of the wider community, particularly some of the more vulnerable, women and children.

If the sale of alcohol is a reportable transaction, the new conditions require the licensee to give police details of the purchaser including name, age, and place of residence as well as details of what was purchased.

Types of purchases of liquor that are reportable include:

  • three or more takeaway liquor purchases of any kind by the same person in any one day
  • takeaway sales to anyone person on any one day in excess of the following:
    • 3 cartons of full strength beer
    • 12 bottles of wine
    • 4 bottle of spirits
    • 48 cans or bottles of RTD’s
  • any other liquor sale which arouses suspicion that the purchaser will commit an offence by possessing, consuming or supplying liquor with all areas of the Pitjantjatjara, Ngaanyatjarra lands and all Aboriginal lands in the Northern Territory.

The new reportable transaction conditions are not intended to inconvenience members of the general public including tourists, interstate or intrastate visitors, cattle station owners and the like purchasing alcohol from takeaway liquor outlets for their own personal consumption. Also, the reportable transaction conditions do not apply where a police auxiliary liquor inspector is on duty at the liquor outlet.

Review of Liquor Commission’s decisions

Section 31 of the Liquor Act 2019 provides for any decision of the Liquor Commission that requires a decision notice under the Act to be reviewable by the Northern Territory Civil and Administrative Tribunal (NTCAT).

A reviewable decision includes:

  • a decision to issue a licence or authority under section 60 of the Act
  • a decision on refusal of transfer of licence under 73(1)(b) of the Act
  • a decision on material alteration of licensed premises under section 97(2) of the Act
  • a decision on variation of conditions of licence under section 112(1) of the Act
  • a decision on variation of conditions of a licence or an authority by the commission under section 113(4) of the Act
  • a decision to impose a condition on the licensees licence or authority in relation to minimum pricing under section 124(2) of the Act
  • a decision on whether to take disciplinary action against a licensee under 166(5)(b) of the Act
  • a decision on whether to declare a general restricted area under section 177(1) of the Act
  • a decision to suspend licence if licensed premises are declared drug premises under section 261 of the Act
  • a decision on a review of a decision of the director of liquor licensing under section 32 of the Liquor Commission Act 2018.

The following persons may apply to NTCAT for a review of the decision:

  • in all cases - the director
  • in the case of a decision regarding a licensee or a licensee's licence, authority or licensed premises - the licensee
  • in the case of a decision regarding an application - the applicant
  • in the case of a submission, complaint or objection that was the subject of a decision - the person who made the submission, complaint or objection
  • in the case of a decision of the commission under part 4 of the Liquor Commission Act 2018 (review of director’s decision) - an affected person.

For the purposes of an NTCAT review, the Liquor Commission Act 2018 and the Liquor Act 2019 are relevant.

Variation of conditions of licence or authority by the Liquor Commission

Section 113 of the Liquor Act 2019 provides for the Liquor Commission, on its own initiative, to vary the condition of a licence or an authority other than a condition added or varied by the minister under section 88, and sets out the process.

Before varying the conditions, the commission must give the licensee a written notice that states the proposed variation and reasons for the proposed variation and invites the licensee to submit a response to the proposed variation within 28 days after the date of the notice.

The commission may vary the conditions of the licence or authority as proposed in the notice or in another way the commission considers appropriate after considering any response of the licensee submitted within the 28-day period, the results of any hearing; and the public interest and community impact requirements.

As soon as practicable after deciding to vary the conditions, the commission must give a decision notice to the licensee.

The variation takes effect on the later of the following - the date on which the licensee receives the decision notice or the date stated in the decision notice.

On 3 November 2021, the Liquor Commission gave notice of proposed variations of conditions of licences, pursuant to section 113 of the Liquor Act 2019.

Affected licensees are invited to submit a response to the proposed variations within 28 days of the above notice (by 1 December 2021).


Review of takeaway licence conditions in Alice Springs

On 12 June 2018, following an own initiative inquiry, the Northern Territory Liquor Commission varied conditions regulating takeaway sales for 19 liquor licences in the Barkly region. In its decision, the commission noted that it had received community representations to also hold a similar inquiry in Alice Springs.

Having considered those representations, the commission decided to inquire into the licence conditions regulating the supply of takeaway liquor in Alice Springs and the surrounding district.

On 3 September 2018, the commission commenced consultations by notifying potentially affected licensees and invited written submissions. Submissions were also invited from members of the public, government agencies and community organisations relating to conditions which might apply to takeaway licences in Alice Springs and the surrounding district with a view to minimising alcohol related harm in the community. Submissions closed on 28 September 2018. Submissions not marked as confidential are posted below.

The commission has concluded its review having considered the information, data, views and suggestions it received through the consultation process.

By formal notice required under section 33(3) of the Liquor Act 1978, the commission has notified specified licensees of its proposal to add conditions to takeaway licences requiring the reporting of suspicious transactions, in order to assist police to detect, prosecute, deter and prevent illegal secondary supply of liquor. Further, the commission proposes to impose a special condition on the Kulgera Hotel and the Desert Oaks Motel (Erlunda) similar to restrictions on the sale of takeaway liquor currently in force for the Curtin Springs Roadhouse.

By notice on 28 May 2019 the commission has notified specified licensees of its decision to vary the conditions of licences, pursuant to section 33(4) of the Liquor Act 1978.

Following the issue of the above mentioned decision notice, five licensees applied to Northern Territory Civil and Administrative Tribunal (NTCAT) for a review of the decision. On 2 August 2019, NTCAT stayed the decision and under s49 of the Northern Territory Civil and Administrative Tribunal Act 2014, invited the commission to reconsider the decision.

On 11 November 2019, the commission conducted a public hearing to assist it in reconsidering the decision. On 29 November 2019, the commission formally notified specified licensees of its second proposal to vary the conditions of takeaway licence conditions.

On 5 January 2024, the Liquor Commission notified Alice Springs liquor licensees that operate with takeaway or grocery store authorities of its proposal to vary liquor licence conditions with a view to update, simplify and harmonise existing conditions in relation to reportable transactions and CCTV surveillance.

May 2018 Variation of conditions of liquor licences - Barkly region

The Northern Territory Liquor Commission has concluded its inquiry into the supply of takeaway liquor in the Barkly region and has determined to vary the conditions of licences in the way the commission considers appropriate.

Pursuant to section 33(4) of the Liquor Act, the commission has given written notice to licensees of its final determination in relation to takeaway trading hours and takeaway limits throughout the Barkly, and the reasons for the proposed variations.


Review of takeaway licence conditions in Victoria River region

The Northern Territory Liquor Commission has determined to conduct an inquiry on its own initiative under section 113 of the Liquor Act 2019 with the view to considering whether restrictions on certain takeaway liquor products should be imposed on licensees in the Victoria River region.

The Commission conducted a public hearing at Yarralin on Friday, 6 August 2021 which was attended by licensees and other interested parties.  The Commission invited written submissions and proposed to publish all submissions, unless marked ‘confidential’.

COVID notice

Public notice – COVID-19 measures

In response to the relaxation of COVID-19 measures, the Liquor Commission has determined to resume the conduct of public hearings unless it determines that conducting a public hearing is not appropriate, as provided for under section 21(2) of the Liquor Act 2019.

To reduce the number of possible people in waiting areas, persons are encouraged to telephone 08 8999 1800 and provide their name and a contact number to be called immediately ahead of required attendance.

With sufficient notice, the commission can arrange for appearance by audio visual link, telephone or attendance in person provided that room capacity is not exceeded. To make arrangements, email liquor.commission@nt.gov.au.
