Reform of summary offences

This consultation is now closed.

The Department of the Attorney-General and Justice had completed the attached report on the Summary Offences Act.

The report recommends that the Act be repealed and replaced with modern legislation with most of the provisions to be located in other legislation such as the Criminal Code. The report also recommends that a number of offences be repealed and not replaced.

The report also provides for a review of the maximum penalties that can be imposed. This report follows an issues paper that was released in late 2010.

The proposals in the report should not be taken as representing the final views of the Northern Territory Government or the Northern Territory Attorney-General and Minister for Justice.

Your comments are sought on both the generality of the report but particularly on the following issues:

  • The proposals concerning which offences should be repealed or retained or amended;
  • The proposed penalties for the various offences
  • The proposal that most summary offences be located in the Criminal Code

We are seeking your comments and feedback on the operations of the proposals by 1 October 2013.
